1. Acceptance of Terms

By accessing or using the System Navigator website, purchasing our products, or using our software and digital services, you agree to be bound by these Terms and Conditions. System Navigator is a digital product and platform owned and operated by Pixellark Solutions. If you do not agree to these terms, please do not use our services.

2. Services Overview

System Navigator provides exclusively digital solutions, including:

  • Digital products and software licenses
  • Business management systems (POS, ERP, etc.)
  • Cloud-based software solutions and technical support services

We reserve the right to modify, update, or discontinue any feature or service within System Navigator at any time.

3. User Responsibilities

You agree to:

  • Provide accurate, valid, and up-to-date information during registration and use
  • Maintain the strict confidentiality of your account credentials
  • Use our digital services only for lawful business purposes
  • Not misuse, reverse-engineer, hack, or disrupt our hosting servers and systems

4. Orders and Payments

  • All digital orders and subscriptions are subject to acceptance and availability
  • We reserve the right to cancel or refuse any order due to errors, suspected fraud, or billing anomalies
  • You agree to provide valid and authorized payment details
  • Subscription and product prices may change, but notices will be provided for active subscriptions

Payment Methods: We use secure third-party payment gateways. System Navigator and Pixellark Solutions do not store full payment details on our servers.

4.1. Transition of Free Server Usage & Legacy Plans

  • Discontinuation of Free Tier (2026-07-01): Previously, System Navigator offered free server usage for cloud-based systems with fewer than 2,000 requests per day. Due to shifting market conditions and rising infrastructure costs (including global RAM and NVMe price increases), this free tier has been officially discontinued, subject to select internal exceptions.
  • Special Legacy Pricing: Affected users transitioning from the free tier are required to select a paid subscription to maintain service. To assist with this transition, we have introduced special legacy plans starting at $0.99/month exclusively for these users.
  • One-Year Free Extension Request & Offline Alternative: Eligible transitioning users may request a one-year extension of free server usage. Upon approval, the $0.99/month plan will be activated and fully subsidized (free of charge) for a strict duration of one (1) year. Following the conclusion of this one-year extension, the user must commence standard payments for that plan to avoid service interruption.
    If you do not agree to this cloud transition, please do not request the free extension. Instead, contact us at 0778941889 to lodge a complaint, and we can arrange a completely offline version of the software that you can use for free indefinitely. Important: Once you explicitly choose to proceed with cloud server hosting, you permanently forfeit the option to request or switch to the free offline software.
  • No Downgrades on Special Plans: Once a user selects and activates one of these special legacy plans, the plan transitions permanently into a Lite Plan at that chosen price point. Users are strictly prohibited from downgrading this plan further once selected.
  • Market-Based Price Adjustments: System Navigator reserves the right to adjust server and subscription fees in response to market conditions, infrastructure cost inflation, or hardware price increases.
    • Active Subscriptions: Price adjustments will not affect the pricing of a currently active, prepaid billing cycle.
    • Renewals: Any market-driven price changes will apply moving forward at the time of the subscription's next renewal cycle.

5. Digital Delivery

Since System Navigator offers strictly digital software solutions, delivery is made electronically. Access to software licenses, downloads, or cloud control panels is provisioned immediately or within the specified setup timeframe upon successful payment verification.

6. Refunds and Cancellations

⚠️ Important (Digital Products & Software):

  • All digital products, software licenses, and cloud-system setups are generally non-refundable once access has been delivered or generated.
  • To ensure System Navigator meets your business needs, you are encouraged to request a system demo or evaluation before finalizing your purchase.
  • Subscription cancellations will stop future billings, but previous payments are non-refundable unless specified by separate written service-level guarantees.

7. Software License and Usage

You are granted a non-exclusive, non-transferable, and revocable license to use System Navigator software according to your purchased plan. You may NOT:

  • Resell, lease, rent, or redistribute the software to third parties
  • Reverse engineer, decompile, or modify the core source code of the system
  • Use System Navigator to process data for illegal or unauthorized activities

All intellectual property rights regarding System Navigator remain exclusively owned by Pixellark Solutions.

8. Intellectual Property

All content included on this website and within the software application, including:

  • Software source code, architecture, and databases
  • Website and user interface layouts
  • Logos, branding assets, and System Navigator trademarks
  • Documentation, text, and accompanying graphics

are the property of Pixellark Solutions and are fully protected under intellectual property laws.

9. Data and Privacy

Your use of our digital platforms is also governed by our Privacy Policy.

  • You retain absolute ownership of all business data uploaded to System Navigator
  • We implement industry-standard security measures and encryption, but cannot guarantee 100% absolute protection against sophisticated external cyber threats

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Pixellark Solutions is not liable for any indirect, incidental, or consequential damages
  • This includes, but is not limited to, loss of profits, data corruption, system downtime, or business interruption

Our total cumulative liability is limited to the actual amount paid by you for the System Navigator service during the specific period giving rise to the claim.

11. Warranty Disclaimer

System Navigator software and services are provided on an "as is" and "as available" basis. Pixellark Solutions does not guarantee:

  • Completely error-free or bug-free operation
  • Uninterrupted, continuous website or server availability
  • That the software will meet every single unique operational expectation unless custom-developed under a separate scope of work

12. Termination

We reserve the right to temporarily suspend or permanently terminate your access to System Navigator if you:

  • Violate any provision of these terms and conditions
  • Fail to settle due subscription or licensing payments
  • Engage in actions that threaten the stability, safety, or integrity of our digital infrastructure

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Sri Lanka. Any legal disputes or claims arising out of the use of System Navigator shall be handled exclusively in the competent courts of Kurunegala, Sri Lanka.

14. Changes to Terms

We may update these Terms from time to time. Continued use of System Navigator after modifications are posted signifies your formal acceptance of the updated terms.

15. Force Majeure

We are not responsible for service interruptions, server downtimes, or failures caused by events completely beyond our control, including natural disasters, global internet/routing failures, cloud hosting vendor outages, cyber warfare, or government restrictions.
